Sqwod Pod offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

We reserve the right to limit the quantities of any products or Services that we offer. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

 
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

In no case shall Sqwod Pod, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Sqwod Pod and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

 
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

 
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - ELIGIBILITY AND USING THE SQWOD POD SERVICES

You must be at least 18 years old and able to enter into legally binding contracts to access and use the Sqwod Pod Platform or register for a Sqwod Pod Account. Sqwod Pod Pods (which refer to Sqwod Pod’s physical locations, including common areas, access areas, as applicable, and are accessible via the Application, the Site, or any other means), are not available to persons under the age of 18. By using the Site, Application or Sqwod Pod Pods, you represent and warrant that you are at least 18 years old and have the legal capacity and authority to enter into a contract. Your participation in using the Sqwod Pod Platform or the Sqwod Pod Pods is for your sole, personal use and not for commercial purposes. You may not authorize others to use your user name and/or password, and you may not assign or otherwise transfer your user account and/or password to any other person or entity. When using the Sqwod Pod Platform or Sqwod Pod Pods, you agree to comply with all applicable laws of the the country, state, province and city in which you are present while using the Sqwod Pod Platform or Sqwod Pod Pods.

SECTION 21 - TERMS FOR TRAINERS & COACHES

If you are a personal trainer, you must have a valid professional liability (personal trainer) insurance policy, in order to use the Sqwod Pod as a trainer. Insurance policy must be in force at the time you register for an Account and must be kept in force at all times during your use of the Sqwod Pod Services. Sqwod Pod reserves the right to request a copy of a trainer’s insurance policy at any time and any additional information we may require.

As further described in the Privacy Policy, Sqwod Pod uses a third-party payment processor (the “Payment Processor”) to link your credit card account to the Site and the Application. The processing of payments or credits, as applicable, in connection with your use of the Site, Application and Sqwod Pod will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to this Agreement. Sqwod Pod is not responsible for any errors by the Payment Processor.

By using the Sqwod Pod Services, you agree to be bound by and comply with any additional terms, conditions and policies provided by the owner, tenant, and property manager of the Sqwod Pod Spaces (collectively, the “Property Managers”) relating to the use of a specific Sqwod Pod, including compliance with building security procedures, IT access and use procedures provided by the Property Manager (the “Manager’s Policies”). The Manager’s Policies may be provided in electronic format through the Application, Site or in hardcopy format at the Sqwod Pod.

SECTION 22 - ACCOUNT REGISTRATION


In order to be able to use the Site, Application or the Sqwod Pod you first need to sign up for an account with Sqwod Pod, which you can do through the Site or through the Application. When signing up, you will be asked to provide Sqwod Pod with your personal information, mobile telephone number and credit card information (which will be held and processed by our third party Payment Processor further details of which are set out in the paragraph above and in our Privacy Policy). Once you complete your sign-up with Sqwod Pod, you will be provided with a personal account (an “Account”). You agree to maintain complete, accurate, and up-to-date information in your Account. Your failure to maintain complete, accurate, and up-to-date Account information, including having an invalid or expired credit card on file, may result in your inability to access and use the Site, Application or the Sqwod Pod. If you provide information that is untrue, inaccurate, not current or incomplete, or if Sqwod Pod has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Sqwod Pod reserves the right to suspend or terminate your Account and refuse any and all current or future use of the Sqwod Pod Services. You may not use the Sqwod Pod Services for any illegal purpose or in any manner inconsistent with these Terms.

You are responsible for all activity that occurs with respect to your Account, including, without limitation, use of the Site, Application, and Sqwod Pod. Without limiting the foregoing, for any reservation made through your Account, if other persons are present in the Sqwod Pod, you hereby agree to be fully responsible and to indemnify Sqwod Pod for any violation of these Terms or applicable laws, by-laws or regulations, even if such violation was caused by such other persons.

You acknowledge that Sqwod Pod may collect and store Your personal information and behavior within the Platform, and You hereby consent to such collection and storage.

You acknowledge and agree that Sqwod Pod: 1) may preserve Content; and 2) may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Sqwod Pod, its users and the public.

SECTION 23 - SQWOD POD HOUSE RULES

By using the Sqwod Pod Services, you agree that:

  • You will not use the Sqwod Pod Platform and Sqwod Pod for unlawful or illegal purposes.
  • You will not use the Site, Sqwod Pod or Application for any inappropriate purposes, including but not limited to drug use, alcohol abuse, gambling or prostitution, pornography, sexual activity, violent or threatening behavior, skateboarding, biking, roller-skating, rollerblading, or any other purpose reasonably likely to reflect negatively on Sqwod Pod or any Building Owner.
  • It is explicitly prohibited to smoke or vape in the Sqwod Pod.
  • You will not light or allow any candles, incense sticks or naked flames in the Sqwod Pod.
  • You will not make excessive noise in the Sqwod Pod, create any noise nor conduct any other activity which would in Sqwod Pod’s or any Building Owner’s judgment disturb other Sqwod Pod clients, guests, or other tenants in any building containing a Sqwod Pod Space.
  • You will not bring or keep any animals in the Sqwod Pod, except for service animals, which shall at all times be harnessed or leashed.
  • You will follow all additional rules, regulations, and by-laws regarding the Sqwod Pod, as may be communicated through the Application, Site, posted signs, or otherwise.
  • You will not use the Site, Application or Sqwod Pod for sending or storing any unlawful material or for fraudulent purposes.
  • You will not install, remove or modify any fixtures, equipment, machinery or appliances in the Sqwod Pod.
  • You are responsible for leaving the Sqwod Pod in a clean and tidy condition.
  • Neither Sqwod Pod nor any Building Owner is responsible for any property you may leave behind in a Sqwod Pod Space. It is your responsibility to ensure that you have taken all of your personal belongings when leaving a Sqwod Pod Space.
  • You may be held liable for any costs to clean the Sqwod Pod in the event that Sqwod Pod determines, in its sole discretion, that you have not left the Sqwod Pod in a clean and tidy condition following its use.
  • You may be held liable for any costs to repair any damage to the Sqwod Pod and items therein during your use of the Sqwod Pod Space.
  • You may be held liable and will be charged by Sqwod Pod for any items that are taken from the Sqwod Pod.
  • You will not use the Site, Sqwod Pod or Application to cause nuisance, harassment, or inconveniences to other users, Building Owners, tenants or others.
  • You will not copy, or distribute the Site, Application or other content without written permission from Sqwod Pod.
  • You will not try to harm the Site, Sqwod Pod or Application in any way whatsoever.
  • You will provide Sqwod Pod and/or the Building Owner with whatever proof of identity we/they may reasonably request.
  • When using the internet within the Sqwod Pod, you shall only use it for lawful purposes, and without restricting the foregoing, you shall not use it for purposes of illegal or criminal acts, consumer fraud, etc.
  • All users must wear clothing appropriate to the building’s situation while using the Sqwod Pod.
  • There is a capacity limit as to the number of persons permitted in a Sqwod Pod Space at any given time, and such limit shall be posted on the Application or Site, and you hereby agree to adhere to the such capacity limit.
  • You hereby consent to the use of sensors by Sqwod Pod to track the location of various items in the Sqwod Pod, which (without limitation) shall be used by Sqwod Pod to optimize the Sqwod Pod.
  • If you feel that any Sqwod Pod member or person in a Sqwod Pod Space that you interact with, whether online or in person, is acting or has acted inappropriately, including but not limited to, anyone who (i) engages in offensive, violent or sexually inappropriate behavior; (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities and then to Sqwod Pod with your police station and report number (if available), provided that your report will not obligate us to take any action beyond that required by law, if any, or cause us to incur any liability.
  • You further acknowledge that your use of the Sqwod Pod does not constitute Sqwod Pod or the Building Owner granting you a lease, but is rather a limited, revocable, non-exclusive, non-transferable contractual license to use, subject to the terms of this Agreement. In its sole discretion and without limiting any of Sqwod Pod’s other rights hereunder, Sqwod Pod may restrict your access to the Sqwod Pod in the event of fraud, trespassing, or violation of this Agreement.

SECTION 24 - DAMAGES, REPAIRS OR CLEANING FEES

As a user of a Sqwod Pod , you are responsible for leaving the Sqwod Pod (including any property in the Sqwod Pod ) in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the Sqwod Pod.
 
Following each and every use of a Sqwod Pod , you are responsible for, and, without limiting any of Sqwod Pod’s other rights hereunder, Sqwod Pod may charge you for: 
• the cost of repair and/or replacement for damage to Sqwod Pod resulting from your violation of this Agreement or your use of the Site, Application, or Sqwod Pod s in excess of normal “wear and tear” (the “Repair or Replacement Costs”). If Sqwod Pod, in its reasonable discretion, determines that excessive repair is required, Sqwod Pod reserves the right to charge the payment method designated in your Account for the reasonable cost of such repair or replacement, as well as an additional service fee which shall not exceed 500 Euro per occurrence. Any such amounts are non-refundable and at the reasonable discretion of Sqwod Pod; and/or 
• Without limiting the generality of the foregoing, the cost to clean a Sqwod Pod resulting from your violation of this Agreement or your use of a Sqwod Pod wherein it has been determined, in Sqwod Pod’s sole discretion, that you have failed to leave a Sqwod Pod in a clean and tidy condition (the “Cleaning Fee”). In respect of such a Cleaning Fee, Sqwod Pod reserves the right to charge the payment method designated in your Account the amount of 25 Euro, per occurrence. Any such amounts are non-refundable and at the reasonable discretion of Sqwod Pod.

SECTION 25 - SMS MESSAGING

Subject to obtaining your consent, Sqwod Pod may send you SMS messages in relation to your bookings and use of Sqwod Pod and for promotional purposes. Message and data rates may apply.

If you change your mobile phone service provider, you might have to re-enroll with Sqwod Pod in order to receive future SMS messages. Sqwod Pod reserves the right to stop sending SMS messages at any time; you may opt-out at any time by replying from your mobile phone to any text from Sqwod Pod with the word STOP, which opt-out will become effective within seven (7) days. It is important to note that opting out of SMS messaging may prevent you from receiving information necessary to properly use the Sqwod Pod service, such as room access codes and other important information.

SECTION 26 - BOOKINGS, CANCELLATIONS AND RESCHEDULING

Sqwod Pod operates on a reservation basis with limited capacity. By making a booking, purchasing a membership, or using any session credits, you agree to the following booking and cancellation terms.

Booking window

You may reserve Sqwod Pod sessions up to 14 days in advance.

We may adjust available time slots, locations, or capacity at any time in order to manage demand and maintain a fair distribution of bookings across all users.

Cancellations and rescheduling

You may cancel or reschedule a session up to 12 hours before the scheduled start time.

  • If you cancel or reschedule less than 12 hours before the start time, the session will be considered used and is not refundable or creditable.

  • If you do not attend your session and do not cancel (a “no-show”), the session will also be considered used and is not refundable or creditable.

These rules apply to all bookings, including one-off purchases, session packs, and subscription sessions, unless expressly stated otherwise in a specific offer.

How to cancel or reschedule

Cancellations and rescheduling must be made through the Sqwod Pod booking system, your online account, or by contacting us through the channels indicated in your booking confirmation. The time of receipt in our system will determine whether the 12-hour window has been met.

Expired sessions and unused credits

Session credits and packages may have an expiry date as communicated at the time of purchase.

Expired sessions and unused credits cannot be refunded, extended, or exchanged, except where required by applicable law or if we explicitly agree in writing.

Right to refuse or modify bookings

We reserve the right, in our sole discretion, to refuse, limit, or cancel bookings if we suspect abuse of the booking system, repeated no-shows, or any violation of these Terms of Service or the Sqwod Pod House Rules. In such cases, we may also restrict future access to the Sqwod Pod Services.
